LUCKNOW: Following chief minister Akhilesh Yadav's orders, the high-level committee appointed to investigate the anomalies in the Teachers Eligibility Test (TET)- 2011 met on Wednesday. Chaired
by Uttar Pradesh chief secretary Jawed Usmani, the closed-door meeting
was also attended by principal secretary, Home, Rajendra Mohan
Srivastava, principal secretary, law, Zakiullah Khan, director general
of police, AC Sharma, secretary, secondary education, Pankaj Kumar and
secretary, department of primary education, Sunil Kumar.
The meeting, sources said, was convened to take stock of the teachers'
recruitment racket that rocked the state in November 2011. The
committee was also made responsible for recommending, within 3 weeks,
ways to solve the issue of the TET controversy, and present its views on
whether the 2011 exam should be cancelled as a result of the anomalies
that were discovered.
After the TET results were declared on November 26, last year, the state
government discovered that money was collected from several unemployed
persons by assuring them they would clear the TET. During a probe by the
Special Task Force (STF) the police named as co-accused, Sanjay Mohan,
who was then director of Uttar Pradesh Board of Secondary Education.
Mohan was subsequently arrested, after his role, in allegedly collecting
money from candidates who appeared in the 2011 Teacher Eligibility
Test, was confirmed. The money, the police said, was taken to facilitate
candidates' selection.
In the first week of April, the CM had appointed the committee, asking
it to consider the possibility of cancelling the results of the TET
2011. Objections, however, were raised by many persons who qualified the
test, saying the wrongdoings'' of a few candidates and officers could
not be used as reason to punish others.
After agitating in Lucknow for many days, a delegation of successful candidates also met CM Akhilesh Yadav.

RTE (Right to Education) has been implemented in our Country and
States/UTs have been instructed to follow the guidelines issued by NCTE
(National Counsil for Teacher Eduaction) and Human Resource Department
to ensure compulsory and free education to children age between 6-14
years.
2.
To ensure quality of teaching staff, TET (Teacher eligibility test) has
to be conducted by State Govt. and any person scoring at least 60% of
the total marks are considered to be eligible to become a teacher.
States/ UTs were authorized to provide reservation based of their
policies.
Sir,

Based on above references it is brought to your kind information that
Teacher Eligibility Test(UPTET-2011) was conducted by U P Govt. on 13
Nov 2011 and result was declared on 25 Nov 2011. Result was updated by
Department several times on instruction of High Court, Allahabad as
answer of some question were found wrong/ ambiguous. Aprox 11,50,000
candidates appeared in the test and 2,50,000 were declared successful in
primary level.

Advertisement for filling 72,825 teaching staff in Primary Level was
also published in various News papers during the month of Nov-2011 and
application were invited for filling of these teaching posts.
electoral code of conduct was implemented in state.
A
writ was also submitted in High Court, Allahabad on 21/12/2011 by YADAV
KAPILDEV LAL BAHADUR questioning about validity of Advertisement to
create obstacle in recruitment process. Writ is still pending in High
Court, Allahabad.
Now, election is over, code of conduct is also over but recruitment process could not be started.

Each Candidate has spend Approx Rs. 10,000-12,000 in submission of
Application including Demand Draft, photocopying of documents,
Speed-post expenses etc and still they are facing the state of dilemma
about their recruitment. They are facing extremely sorrowfulness since
long and waiting for the recruitment process to be started.

Other than 2,50,000 candidates which are waiting for recruitment, the
delay in recruitment will also affect Primary Education is the state.
The future of approx 72,825X30 = 21,84,750 students ( 30 students is a
class) is also on the stake.
6. There are approx 25,000 candidates which are on the edge of the competitive age i.e. 35 years. Day by day news is coming - TET is going to cancel, Rules are going to change etc.,
We did each and every thing as per NCTE guideline and Government order, But now we are mentally depressed and facing problems.

Leaving children in hand of untrained teachers/ Shiksha Mitras will be
not a wise idea when approx 2,50,000 trained, TET (Teacher Eligibility
Test) qualified candidates waiting for their recruitment.
8.
Considering the bread and butter of 72,825 X 5 = 3,64,125( 5 members in
a family approx) and future of approx 21,84,750 students age between
6-14 years, you are requested instruct High Court, Allahabad to clear
the obstacles in recruitment process without further delay based on the
original advertisement(without change) considering matter of mass
interest.

मौजूदा स्थिति में दो ही मुद्दे बचे हैं.
पहला, मुद्दा है टी.ई.टी. पर लगे आरोप और सवालिया निशान तो पिछली सरकार के हर काम-काज को संदेह की दृष्टि से देख रही वर्तमान सरकार पात्रता परीक्षा में हुई गड़बड़ियों की व्यापकता को आंक कर इसको रद्द करने या न करने का मजबूत निर्णय लेना चाह रही है. अब अभ्यर्थियों को पता है कि वे ईमानदार हैं पर सरकार के पास जांच के अलावा क्या रास्ता है.
मौजूदा परिस्थिति में कोई नतीजा आने तक आप मुख्यमंत्री को गलत नहीं कह सकते क्यूंकि उन्होंने स्वयं मुख्य सचिव की अध्यक्षता में समिति गठित कर तीन हफ्ते में जाँच रिपोर्ट देने को कहा है.
दूसरा, तकनीकी आधार पर भर्ती पर लगी रोक तो इसका उद्देश्य निस्संदेह असफल उम्मीदवार द्वारा प्रक्रिया बाधित करना है पर यदि यह आधार कानूनी रूप से सही है तो सरकार को मजबूरन विज्ञापन में संशोधन करना होगा या नया विज्ञापन निकलना होगा.
अब ऐसी स्थिति में प्रश्न उठाया जा रहा है कि सरकार ऐसी स्थिति में चयन का आधार बदल सकती है. भले ही अभी तक सरकार ने स्पष्ट न कहा हो पर जनसामान्य का मत है कि समाजवादी पार्टी की मानसिकता वोट के चक्कर में quality (प्रतिभा, जो सामान्यतया कम ही होती है) पर quantity (अधिक से अधिक लोग, भले ही नाकारा) को प्राथमिकता देने की रही है और वह निस्संदेह
उचित-अनुचित का ध्यान रखे बिना ज्यादा, भले ही नाकारा, लोगों को खुश करने के लिए अध्यापक सेवा नियमावली, 1981 के 12 वें संशोधन को रद्द कर पुनः अकादमिक आधार पर मेरिट बना सकती है.
यहाँ मैं टी.ई.टी. मेरिट पर चयन का पक्षधर व्यक्तिगत कारणों से नहीं, बल्कि एन.सी.टी.ई. के दिशानिर्देशों, केंद्र सरकार के एजेंडे और भर्ती-प्रक्रिया शुरू होने से पूर्व टी.ई.टी. मेरिट को भर्ती का आधार घोषित किये जाने की वजह से हूँ.
पर ऐसी स्थिति में सरकार चयन का आधार भले बदल दे अगर यह उसकी संवैधानिक शक्तियों के अंतर्गत है, पर इस खुद सरकार को पता है कि केंद्र से मिलने वाली सहायता के आधार पर हो रही इन भर्तियों के लिए अगर एन.सी.टी.ई. और केन्द्रीय मानव संसाधन विकास मंत्रालय से अनुमति लेनी है तो पहले तो एन.सी.टी.ई. द्वारा अध्यापकों की नियुक्ति के लिए टी.ई.टी. मेरिट की
सिफारिश और अब मानव संसाधन विकास मंत्रालय द्वारा शिक्षा के अधिकार
करने को तैयार है या अकादमिक आधार पर भर्ती को तैयार है ? इन विषयों पर भले ही लोग अपने हित को ध्यान में रखकर किसी आधार का समर्थन करें पर ये बिना मतलब कि बहस है.
